Privacy Policy

The use of services from Tier.Net Technologies, LLC (hereinafter referred to as "Tier.Net", "us", "we", or "our") constitutes agreement to these terms and policies:

Tier.Net operates the www.tier.net website (the "Service").

This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data.

Tier.Net complies with applicable data protection laws, including the EU General Data Protection Regulation (GDPR), and acts as a data processor when processing personal data on behalf of EU-based clients.

Definitions

SERVICE is the www.tier.net website operated by Tier.Net.

SUPPLEMENTARY MEASURES Technical and organizational measures implemented by Tier.Net to protect EU personal data during international transfers, in line with Schrems II requirements, including encryption, access controls, and pseudonymization.

DATA CONTROLLER is the natural or legal person who (either alone or jointly) determines the purposes for which and the manner in which any personal information are, or are to be, processed. For the purpose of this Privacy Policy, we act as a Data Processor for your personal data.

DATA PROCESSORS also called Service Providers, are any natural or legal person who processes data on behalf of the Data Controller. We use the services of various Service Providers in order to process your data more effectively.

DATA SUBJECT also called User, is any individual who is using our Service and is the subject of Personal Data.

2. Retention of Data

We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Tier.Net will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

3. Transfer of Data

Tier.Net will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

For EU Clients: Tier.Net may transfer Personal Data collected from EU clients to countries outside the European Economic Area (EEA), including the United States. Such transfers are governed by Standard Contractual Clauses (SCC 2021/914/EU) to ensure adequate protection of EU personal data.

In addition, Tier.Net implements various supplementary technical and organizational measures, including encryption, access controls, pseudonymization, and continuous monitoring, to mitigate risks arising from differing data protection laws abroad (Schrems II compliance).

By using our Service and submitting your information, you consent to such international transfers and the safeguards described herein.

4. Disclosure of Data

Under certain circumstances, Tier.Net may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

6. Processing Personal Data under General Data Protection Regulation (GDPR)

If you are from the European Economic Area (EEA), Tier.Net legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

When processing personal data on behalf of EU-based clients, Tier.Net acts as a Data Processor under Article 28 GDPR and only processes personal data according to the instructions of the EU client (Data Controller). EU clients can request a Data Processing Agreement (DPA) to formalize these terms.

7. Data Protection Rights under General Data Protection Regulation (GDPR)

EU clients may exercise their rights (access, rectification, deletion, restriction, objection, data portability, and withdrawal of consent) by contacting Tier.Net at [email protected]. For organizational clients, rights can also be exercised through the execution of a Data Processing Agreement (DPA).

Your Data Protection Rights

ACCESS, UPDATE OR DELETE PERSONAL DATA Whenever made possible, you have the right to access, update or request deletion of your Personal Data by contacting Tier.Net at [email protected]. If you are unable to perform these actions yourself, please contact us to assist you.

RECTIFICATION You have the right to have your information rectified if that information is inaccurate or incomplete.

OBJECTION You have the right to object to our processing of your Personal Data.

RESTRICTION You have the right to request that we restrict the processing of your personal information.

DATA PORTABILITY You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.

WITHDRAW CONSENT You also have the right to withdraw your consent at any time where Tier.Net relied on your consent to process your personal information.

8. "Do Not Track"

We support "Do Not Track" (DNT). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

9. Service Providers

We may employ third party companies and individuals to facilitate our Service ("Service Providers"), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.

Payment Information & Processing

Collection and Secure Storage: To facilitate seamless renewals and fulfill our contractual obligations, we collect and securely store credit card information and other electronic payment method details. All payment data is encrypted and maintained in accordance with PCI-DSS (Payment Card Industry Data Security Standard) requirements.

Third-Party Payment Processors: Where applicable, we utilize industry-leading third-party payment processors to securely handle transactions. These include, but are not limited to:

Payment Processors

These processors act as independent data controllers and handle your payment information in accordance with their own respective privacy policies and strict security standards. When you initiate a transaction, your payment details may be collected directly by these providers or shared by us with them solely for the purpose of completing the transaction or managing recurring billing.

Data Transfers and Security: Transfers of payment data to our third-party partners are conducted under the legal basis of Contractual Necessity. These transfers are performed using industry-standard encryption (TLS/SSL) to ensure your data remains protected from unauthorized access during transit.

Right to Erasure and Retention Policy: In accordance with your rights under the GDPR, you may request the deletion of your stored payment credentials at any time. We will honor such requests provided that the following conditions are met:

  • Account Standing: Your account must be in good standing with no outstanding balances or pending disputes.
  • Contractual Commitment: You have satisfied the minimum term of any active service commitment or subscription period.

Please Note: Deleting payment information during an active subscription term will require you to provide an alternative valid payment method to prevent service interruption or suspension. We may also retain minimal transaction records (excluding full card numbers) where necessary to comply with legal, tax, or auditing obligations.

Blockchain Immutability Disclaimer: If you choose to pay using cryptocurrency or other blockchain-based methods via BitPay, please be aware of the following technical limitations regarding the "Right to Erasure":

  • Permanent Public Ledger: Transactions conducted on a blockchain are recorded on a decentralized, public, and immutable ledger. By design, these records (including transaction IDs, wallet addresses, and payment amounts) cannot be modified or deleted by us or by the payment processor.
  • Scope of Deletion: While we will honor requests to delete your personal information from our internal databases (subject to the account standing requirements mentioned above), we cannot remove the historical record of your transaction from the blockchain itself.
  • Pseudonymity: Although blockchain data is public, it is generally pseudonymous. We do not link your identity to these public records beyond what is strictly necessary for internal accounting and compliance purposes.

10. Data Processing Agreement (DPA)

Tier.Net offers a GDPR-compliant Data Processing Agreement (DPA) for EU clients. The DPA outlines Tier.Net's obligations as a Data Processor under Article 28 GDPR, including subprocessors, international transfers, security measures, and breach notification procedures.

The DPA incorporates the European Commission’s Standard Contractual Clauses (SCC 2021/914/EU) where required for international data transfers.

11. Links to External Sites

Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

11. Children's Privacy

Our Service does not address anyone under the age of 18 ("Children").

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from Children without verification of parental consent, we take steps to remove that information from our servers.

12. Changes to Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the "effective date" at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

Tier.Net reserves the right to responsibly disclose or publish information in response to a social media post, article, or review that you publish about us or our services.
